Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between the company SAS NRJ DISTRIB, operating the website chargepro.fr, and any consumer or professional (hereinafter "the Customer") wishing to make an online purchase.
Any order placed on the site implies full and unreserved acceptance of these GTC.
Article 2 – Products
CHARGEPRO.FR sells charging stations for electric vehicles (portable chargers, AC wallboxes, DC fast chargers) as well as associated installation services.
The essential characteristics of the products are presented on each product page. Photographs are for illustrative purposes only and are not contractually binding.
Article 3 – Price
Prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs. SAS NRJ DISTRIB reserves the right to modify its prices at any time. Products are invoiced at the price in effect at the time the order is confirmed.
Article 4 – Order
The Customer places an order online via the chargepro.fr website. The order is definitively validated after payment confirmation. A confirmation email is sent to the Customer at the address provided during the order.
SAS NRJ DISTRIB reserves the right to cancel or refuse any order in the event of a dispute relating to the payment of a previous order or suspicion of fraud.
Article 5 – Payment
Payment is made online using the methods offered on the site (credit card, etc.). Payment is secure. The Customer's banking data is not stored by SAS NRJ DISTRIB.
Article 6 – Delivery
Products are delivered to the address indicated by the Customer when placing the order. Delivery times are indicative. In the event of delay, SAS NRJ DISTRIB cannot be held responsible if this delay is due to an event of force majeure or a third-party carrier.
Delivery costs are indicated before the order is confirmed.
Article 7 – Right of Withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the consumer Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide reasons or pay penalties.
To exercise this right, the Customer must notify their decision by email or mail before the deadline expires. Return shipping costs are borne by the Customer, unless the product is defective or non-compliant.
Exception: The right of withdrawal does not apply to customized products or installation services already performed with the Customer's consent.
Article 8 – Warranties
All products benefit from the legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
In the event of a lack of conformity, the Customer may request the repair or replacement of the product, or, if this is impossible, a refund.
Article 9 – Liability
SAS NRJ DISTRIB cannot be held responsible for indirect damages resulting from the use of the products. The liability of SAS NRJ DISTRIB is limited to the amount of the order concerned.
Article 10 – Personal Data Protection (GDPR)
Personal data collected during the order is processed by SAS NRJ DISTRIB as data controller, in accordance with the General Data Protection Regulation (GDPR – EU 2016/679) and the French Data Protection Act.
This data is used for order processing, customer relationship management, and, with the Customer's consent, for marketing purposes.
The Customer has a right to access, rectify, erase, portability, and object to their data. To exercise these rights, the Customer can contact SAS NRJ DISTRIB via the contact form on the website.
Article 11 – Intellectual Property
All content on the chargepro.fr website (texts, images, logos, etc.) is the exclusive property of SAS NRJ DISTRIB and is protected by intellectual property law. Any reproduction without authorization is prohibited.
Article 12 – Applicable Law and Disputes
These GTC are subject to French law. In the event of a dispute, the Customer may resort to conventional mediation or any other alternative dispute resolution method.
In accordance with article L.612-1 of the French Consumer Code, the consumer Customer may use a consumer mediator free of charge. The European Commission also provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Failing an amicable resolution, French courts shall have sole jurisdiction.
